Erie County Clerk Michael Kearns is seeking an injunction against the state of New York in order to prevent them from enacting the Green Light law, which is an outrageous piece of legislation that would require county clerks to issue driver’s licenses to illegal aliens.

The federal lawsuit was filed Monday night and seeks federal court clarification as to whether the state government can legally compel county clerks to issue a driver’s license to an illegal alien.
             
According to his legal research team, he may be the first independently elected officials to challenge this legislation in court. Kearns has said he’s “willing to follow this all the way to the Supreme Court.” He believes the county has a “strong argument” that Governor Cuomo’s law would require county clerks to violate federal law.
             
Kearns argues that this legislation will put county clerks in a lose-lose situation. The clerks can either violate federal law by issuing a license to an illegal alien or violate state law by refusing to issue a license on the basis of the person being an illegal alien.
